Red Hat has initiated legal proceedings against Daniel Pocock concerning trademark infringement of Fedora in the domain name WeMakeFedora.org, which hosted criticism aimed at participants of the Fedora project and Red Hat. Representatives of Red Hat demanded the transfer of domain rights to the company, citing violations of the registered trademark, but the court ruled in favor of the defendant, allowing the current owner to retain rights to the domain.
The court indicated that according to the information published on the WeMakeFedora.org website, the author's activities fall under the category of fair use of the trademark, as the name Fedora is used by the defendant to identify the theme of the site, which publishes criticism related to Red Hat. The site is non-commercial, and its author does not attempt to present it as a product of Red Hat's activities or mislead users.
Daniel Pocock was previously among the developers of Fedora and Debian, handling maintenance of several packages, but due to a conflict, he confronted the community, began trolling some participants, and publishing criticism mainly directed against the imposition of a code of conduct, interference in community life, and the promotion of various initiatives carried out by activists for social justice.
For example, Daniel sought to draw attention to the activities of Molly de Blanc, who, in his opinion, under the guise of promoting a code of conduct, was bullying dissenters from her viewpoint and attempting to manipulate the behavior of community members (Molly is the author of an open letter against Stallman). For his harsh statements, Daniel Pocock was banned by projects such as Debian, Fedora, FSF Europe, Alpine Linux, and FOSDEM, but he continued his attacks on his websites. Red Hat attempted to seize one of his sites under the pretext of trademark infringement, but the court sided with Daniel.
