IBM has won an appeal against a ruling from the Southern District of Texas issued in 2022, regarding a $1.6 billion compensation it was supposed to pay BMC Software Inc. for wrongfully replacing its software with its own on the mainframes of their mutual client AT&T Inc., reports The Register. This week, the Fifth Circuit Court of Appeals in New Orleans deemed the lower court's ruling regarding IBM's liability erroneous. On behalf of a three-judge panel, Judge Edith Jones stated that AT&T, one of BMC's largest clients, transitioned to IBM's software 'on its own' and that BMC 'fairly lost to IBM.'
