So let's quickly go through the main points.
If you have not posted a privacy policy on your website, individuals (including individual entrepreneurs) may be held liable with a fine of up to 10,000 rubles, while organizations can face fines of up to 30,000 rubles. If you process personal data without client consent, the fine for the company will be up to 75,000 rubles. For individuals, the director of the organization or individual entrepreneurs, the fine can be up to 20,000 rubles.
Until July 1, 2017, protocols for violations in the processing of personal data were drawn up by the Prosecutor's Office. The fines were not very significant: 1,000 rubles for individuals and 10,000 rubles for organizations. The process of checking and imposing fines was slow and cumbersome, and considering the relatively small amounts of fines, checks were carried out quite rarely.
Now checks are conducted on a much larger scale and the process of documentation has shortened as the Federal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor) is now in charge of enforcing personal data legislation. Alexander Zharov, the head of Roskomnadzor, has tasked his staff with checking e-commerce companies for compliance with the "On Personal Data" law. Zharov announced this on Tuesday, April 16, at a departmental meeting. "There is a lot of money involved and many rights are being violated," noted the head of Roskomnadzor.
