APKIT asked the Deputy Prime Minister to postpone the entry into force of the law on mandatory pre-installation of domestic software

Association of Computer and Information Technology Enterprises (APKIT) asked Deputy Prime Minister Dmitry Chernyshenko postpone indefinitely entry into force law on mandatory pre-installation of domestic software on smartphones, computers and Smart TV. There are less than two months left before the law comes into force, but officials still have not explained what software and in what order to install on devices, market participants explain. The corresponding resolution is still being worked out by the government.

Law on pre-installation of domestic software comes into force from 1 January 2021 year and obliges the installation of domestic programs on smartphones, computers and Smart TVs when they are sold. For violations, it is proposed to fine officials up to 50 thousand rubles, and legal entities - up to 200 thousand rubles. The law was supposed to come into force in July 2020, but on March 31, the State Duma delayed entry until January 1.

APKIT reminds that the procedure for installing domestic programs, the types of devices on which they need to be installed, the possibility of selling electronics previously imported into the country without Russian software (software), and even its list and types have not yet been determined.

It is unclear who will monitor compliance with the requirements of the law. Due to legal uncertainty, manufacturers will not have time to install Russian software on devices by 2021, APKIT concludes.

“We have met several times to discuss the requirements and pre-installation procedures with specialized associations, equipment manufacturers, and retailers. We heard general concerns about the timing, and we are currently exploring options that will balance the interests of all participants,” said Deputy Head of the Ministry of Digital Development Maxim Parshin.
