Apple loses 'One More Thing' rights to Swatch in Australia

Apple for the second time in a month was defeated in court by watchmaker Swatch. She failed to convince the Australian Trademark Office that Swatch should be denied the "One More Thing" slogan, synonymous with Apple events and made famous by co-founder and former CEO Steve Jobs, who often used this phrase at the end of the event during the presentation of the next company's new products.

However, the court sided with Swatch, confirming its right to use the slogan, and Apple, as the losing party, will have to pay legal costs.

Judge Adrian Richards agreed with Swatch's argument that Apple does not use the phrase for certain products or services, but only at its events.

"These words, spoken once before the introduction of a particular new product or service (Apple), are then never used again in relation to that product or service," Richards said in the ruling. He further expressed the opinion that the "ambiguous and temporary use" of this phrase is not the basis for claiming rights to it as a trademark.

In early April, Apple lost a lawsuit against Swatch in Switzerland over the "Tick Different" marketing phrase. The American company found it similar to the slogan used by it "Think Different" (Think different). However, the Swiss Federal Administrative Court ruled that the phrase was not sufficiently known in the country to deny the possibility of Swatch using its slogan.
