Court to consider Huawei's motion to declare sanctions against it unconstitutional

Huawei has filed a motion for summary judgment in a lawsuit against the US government in which it accuses Washington of exerting unlawful sanctions pressure on it to force it out of the global electronics market.

The petition was filed in the U.S. District Court for the Eastern District of Texas and complements a lawsuit filed back in March with a request that the 2019 National Defense Authorization Act (NDAA) be declared unconstitutional. According to Huawei, the actions of the American authorities are contrary to the constitution, as it uses the law instead of the court.

Recall that it was on the basis of the aforementioned law that in mid-May the US Department of Commerce blacklisted Huawei, thereby prohibiting it from purchasing components and technologies from American manufacturers. Because of this, the company is threatened with "weaning" from the Android mobile software platform, which it uses in all its smartphones and tablets; as well as a ban on the use of the ARM microprocessor architecture underlying its HiSilicon Kirin single-chip systems.

Huawei lawyers also noted that Washington's current actions set a dangerous precedent, as they could target any industry and any enterprise in the future. They also noted that the US has so far not provided any evidence that Huawei is a threat to the country's national security, and all sanctions against the company are based on speculation.
