San Francisco federal judge Charles Breyer has dismissed for the second time a securities fraud lawsuit filed by Tesla Inc shareholders alleging the company made misleading comments about the production status of its Model 3 electric car.
A U.S. District Judge sided with the electric vehicle maker in dismissing the lawsuit filed in October 2017. Breyer dismissed the original lawsuit in August, but allowed the plaintiffs to file it again, subject to corrections.
The class action lawsuit involves shareholders who purchased Tesla shares between May 3, 2016 and November 1, 2017.
