The Chinese company TikTok filed a lawsuit against the US presidential administration on Monday. It is noted that the TikTok management tried to find contact with the American leadership, offered various options for resolving the issue, but the States ignored all legal procedures and tried to interfere in commercial negotiations.
βThe [President Trump] administration has ignored all of our active and good-faith attempts to resolve the issue. We take the lawsuit against the US government very seriously. We simply had no other choice to protect our rights, the rights of our employees and the rights of our community, βthe statement reads.
The lawsuit alleges that Trump's order to ban transactions between TikTok and its parent company ByteDance violates due process and is based on an unsubstantiated claim that TikTok poses a threat to US national security. At the same time, the decree does not say what kind of transactions are in question.
In its statement, TikTok also indicates that Trump ignored all attempts by the company to cooperate with the US Committee on Foreign Investment (CFIUS). This committee deals with the legal assessment of mergers. The Committee dealt with the purchase of the music service Musical.ly by the Chinese company ByteDance with subsequent rebranding into the TikTok service in the United States. Trump, by his executive order, banned this deal, and also demanded that the company give up assets in the United States.
βThis decree is not based on a good faith desire to protect the national interest,β TikTok said in a statement.
As TikTok points out, independent national security experts criticized the politically motivated nature of the presidential decree and expressed doubt that it truly reflects the goal stated by the US leadership.
