The Moscow City Court will consider a lawsuit to completely block YouTube in Russia

It became known that the company Ontarget, which develops tests for personnel assessment, filed a lawsuit with the Moscow City Court to block the YouTube video service in Russia. About it reported Kommersant publication, noting that Ontarget had previously won a lawsuit against Google over the same content.

In accordance with the anti-piracy legislation in force in Russia, YouTube can indeed be blocked for repeated violations, but lawyers believe that the court will not take such a step. According to available data, the hearing of this case is scheduled for June 5.

The claim is based on the fact that there are channels on YouTube whose authors offer job seekers to deceive future employers and take tests for them. In some cases, the authors of such channels use tests that were developed by Ontarget. CEO and founder of Ontarget Svetlana Simonenko noted that the claims consist of a complete blocking of YouTube, since the service committed a repeated violation. In 2018, Ontarget won a similar lawsuit, and the court ordered Google to remove controversial content from YouTube, but the American company never did.

The experts with whom Kommersant representatives spoke are not aware of any cases in which someone tried to block all of YouTube through the courts. Leading analyst of the Russian Association of Electronic Communications Karen Kazaryan believes that blocking the video service will lead to a massive restriction of the rights of citizens and is contrary to the spirit of the Civil Code and the Constitution.

Deputy Chairman of the Committee of the Russian Union of Industrialists and Entrepreneurs on Intellectual Property Anatoly Semyonov explained that usually participants in disputes over pirated content do not try to file for permanent blocking of platforms, so as β€œnot to anger the people and not to confuse the Moscow City Court.” He also emphasized that the problem for the court is that one of the provisions of the Law β€œOn Information” actually obliges to approve the blocking of the entire platform, and not just pages that violate the law.
