According to Priano-Keyser, all of the vendor's smart watches, up to the Apple Watch 4, have defects that cause the lithium-ion battery to swell. Because of this, the display of the gadget becomes covered with cracks or becomes detached from the body. She believes that such defects occur after short-term use.

The plaintiff claims that the manufacturer knew or should have known about the presence of defects before the smartwatch hit store shelves. In her opinion, Apple Watch poses a serious danger to users, since the watch can cause injury to the owner.

It is worth noting that Apple previously acknowledged the possibility that the battery of some smartwatch models may swell, and offered free warranty repairs for three years from the date of purchase of the gadget. Priano-Keyser's statement of claim states that developers often refuse to provide warranty service, characterizing the problem as "accidental damage."

The woman purchased an Apple Watch Series 3 in the fall of 2017. In July 2018, while the device was charging, the display suddenly came off the case and cracked. The smart watch has become unsuitable for further use. After this, Priano-Keyser contacted the service center to have the device repaired under warranty, but they refused.

The plaintiff's complaint describes more than a dozen similar cases that users of Apple products have encountered in recent years. The woman hopes that through the court she and other victims will be able to compensate for the damage caused. It is noteworthy that the complaint only talks about the consequences of the defect, but does not mention the reasons that may affect the swelling of the batteries in the Apple Watch.
