GitHub has announced the establishment of a service to provide free legal assistance to developers of open-source software accused of violating Section 1201 of the DMCA, which prohibits circumventing technical protection measures like DRM. The service will be overseen by lawyers from Stanford Law School, with funding provided by the new Developer Defense Fund, which has allocated one million dollars for its operation. <\/p>\n
The funds will be spent on hiring staff to provide legal consultations for those accused of DMCA violations, training lawyers and students to assist programmers in this area, as well as conducting research and raising awareness of the existing U.S. Digital Millennium Copyright Act (DMCA). <\/p>\n
It is noted that receiving DMCA takedown requests can lead to complex legal issues that developers lack the time and resources to address, and even if the request is unfounded, it is often easier for a developer to accept the deletion of their repository rather than engage in a legal battle. <\/p>\n
The newly established service will provide legal expertise and consultation for developers in this area. In addition to an expert assessment of the validity of the DMCA request by GitHub staff, the developer will be able to receive completely independent legal support that acts in the interest of the community. <\/p>\n
Recall that following the recent incident involving the takedown of the Youtube-dl project, GitHub revised its process for handling takedown requests. Mandatory review by legal and technical experts for each takedown request based on Section 1201 of the DMCA has been introduced. In the absence of clear evidence of unlawful circumvention of protection, takedowns will not occur, and for justified claims, a developer will receive a preliminary notice with time to contest the claim or make corrections to the repository.
