The PGCAC (PostgreSQL Community Association of Canada), representing the interests of the PostgreSQL community and acting on behalf of the PostgreSQL Core Team, has called on the Fundación PostgreSQL to fulfill its previous promises and transfer the rights to the registered trademarks and domain names associated with PostgreSQL. <\/p>\n
It is noted that on September 14, 2021, the day after the public disclosure of the conflict arising from the Fundación PostgreSQL registering the trademarks 'PostgreSQL' and 'PostgreSQL Community' in Spain and applying for similar trademarks in the US and the European Union, representatives of the PostgreSQL Core Team managed to reach an agreement with the Fundación PostgreSQL. The Fundación PostgreSQL stated that it would begin the process of transferring all trademarks and domains to the PGCAC free of charge and without any conditions. <\/p>\n
Seven months have passed since then, but the trademark transfer agreement remains unresolved. The sticking point has been the PGCAC's intention to compensate for the costs incurred during efforts to contest the trademark applications. The PGCAC did not seek full reimbursement of legal costs but requested compensation for the filing fee related to the objection against the trademark registration. The Fundación PostgreSQL refused to cover such expenses, explaining its decision by stating that they could have been avoided if the PGCAC had tried to resolve the matter through direct negotiations without involving legal counsel. <\/p>\n
During the negotiation of the agreement draft, the Fundación PostgreSQL rejected most of the terms proposed to resolve the conflict and suggested adding several of its own terms, while still insisting that it would withdraw the trademark applications in any case, regardless of the conclusion of an official agreement. Ultimately, the preparation of the agreement has stalled, the trademark applications remain unwithdrawn, and the attorney for the Fundación PostgreSQL indicated that the organization is not interested in fulfilling its previous promise regarding the withdrawal of the trademarks (likely implying a refusal to withdraw the trademarks until an official agreement is signed). <\/p>\n
