The DMCA request sent to GitLab states that, like Yuzu, the Suyu emulator is specifically designed to bypass technical protection measures and uses illegally obtained copies of cryptographic keys to decrypt games and firmware. Although the extraction of keys for decrypting games lies with users and is carried out using third-party tools, the mere act of decryption on the emulator side is considered illegal circumvention of technical protection measures by Nintendo, even if the user uses keys extracted from their own purchased copy (the terms of use prohibit creating copies for use on other platforms). <\/p>\n
The Suyu project was created by forking the Yuzu codebase and continued the development of the Nintendo Switch emulator after Yuzu's development was halted due to an agreement with Nintendo to cease legal proceedings. The Suyu developers attempted to address Nintendo's previous concerns and initially stated on their website that they do not condone or promote piracy and intellectual property violations, but rather develop the project solely for research purposes and to preserve the representation of the hardware in the future. <\/p>\n
Suyu is presented as a tool to protect users' interests, ensuring they won't lose the ability to launch purchased games due to external influences or loss of the original medium. The project is positioned as completely free and fundamentally rejects any forms of monetization and donations. At one point, the authors of the Yuzu emulator publicly mentioned that most users of the emulator utilize pirated keys. The Yuzu site contained instructions for key extraction and referenced the need to transfer certain files from hacked consoles, which Nintendo used as a basis to accuse the project of complicity in piracy and unauthorized copying of games.
