The non-profit certificate authority Let's Encrypt, community-controlled and providing certificates free of charge to all who wish, has made a change to its user agreement that defines the rights and responsibilities of certificate recipients. A clause has been added to the section regarding the terms for requesting and using certificates, prohibiting the issuance of certificates for individuals and organizations that permanently reside or are registered in countries or territories subject to comprehensive U.S. sanctions.<\/p>\n

In addition, individuals and organizations that are subject to personal sanctions and U.S. export control restrictions are also prohibited. Organizations controlled by sanctioned individuals or acting on their behalf are similarly restricted. It is noted that Let's Encrypt is registered in the U.S. and is required to comply with export control rules and sanctions in place in the U.S. <\/p>\n

It is still unclear whether the change to the user agreement is a formality reflecting an already implemented practice or if additional measures will be taken to block requests from subnets in sanctioned countries. So far, Let's Encrypt has employed targeted blocks that prevent obtaining certificates for specific domains<\/a>countries listed in the U.S. Office of Foreign Assets Control (OFAC) sanctions lists. <\/p>\n

Comprehensive U.S. sanctions
\nareas subject to sanctions against Crimea, the DNR, the LNR, Iran, North Korea, and Cuba. Hard sanctions have been imposed against Russia, but a full embargo has not yet been applied. Currently, requests to Let's Encrypt for certificates from Russian domains not listed in the sanctions lists are accepted without restrictions.<\/p>\n

Update: Commenting on the change to the user agreement, the director of ISRG (Internet Security Research Group), which is the founding organization of the Let's Encrypt project, clarified that certificates will continue to be issued to individuals and non-governmental companies from Iran and Russia, but will not be available for Russian and Iranian government institutions. According to a representative of Let's Encrypt, the changes simply document an established practice for legal formalities and no new blocking measures will follow. <\/p>\n

The ability to issue certificates for private institutions and individuals in sanctioned territories is enabled by current U.S. laws on the protection of private correspondence and relaxations adopted by the Office of Foreign Assets Control (OFAC) to promote respect for human rights and freedoms on the internet.<\/p>\n
