A brief summary of the bill amending Federal Law No. 152-FZ of July 27, 2006, \"On Personal Data\" (152-FZ). With these amendments, 152-FZ will \"allow trading\" Big Data and strengthen the rights of personal data operators. Readers may find it interesting to pay attention to the key points. \nAs stated in the explanatory note:<\/p>\n

The bill was developed in accordance with item 01.01.003.002.001 of the action plan for the \"Regulatory Regulation\" direction of the \"Digital Economy\" program, approved by the Government Commission for the Use of Information Technologies to Improve the Quality of Life and the Conditions for Entrepreneurial Activities on December 18, 2017, protocol No. 2.<\/p><\/blockquote>\n

\nWhat seems most interesting?<\/p>\n

(Hereinafter, references to 152-FZ are implied)<\/i><\/p>\n

    \n
  1. We meet \"Anonymized Data.\"\n

    \"Anonymized data\" is not the same as \"Anonymized personal data.\" \"Anonymized data\" is identical to anonymized personal data, as described, for example, here<\/a><\/noindex> in the context of GDPR.<\/li>\n

  2. Another consent arises: for the processing of personal data incompatible with the purposes of collecting personal data (supplemented by part 2 of article 5).<\/li>\n
  3. The processing of personal data will now be permitted to prevent property damage, to warn and prevent illegal acts (amendment in paragraph 7, part 1 of article 6) and for achieving socially significant goals (supplemented by paragraph 7.1, part 1 of article 6).<\/li>\n
  4. In paragraph 9, part 1 of article 6, \"or other research\" is replaced with \"research and\/or analytical\" (an important point, we will return to this below).<\/li>\n
  5. A new basis for processing in part 1 of article 6 states: \"12) the processing of personal data obtained by the operator on legal grounds for the purpose of obtaining anonymized data.\" This legalizes the processing for anonymization of data without the involvement of the subject of personal data.<\/li>\n
  6. Article 8.1 is added, which allows for the civil and legal circulation of anonymized personal data. That is, data can be used for commercial purposes and sold to third parties. For statistical, research, and\/or analytical purposes, the subject's consent is not required.<\/li>\n
  7. If the \"anonymity\" of processed anonymized personal data is lost, consent does not need to be sought afterward (but a legal basis will have to be found). This is indicated by the added \"(or)\" in the phrase \"...is carried out with the consent of the data subject and\/or in the presence of the grounds specified in paragraphs 2-11 of part 1 of article 6...\".<\/li>\n
  8. Anonymized data may be used freely without the consent of the subject (amendments to part 4 of article 8.1).<\/li>\n
  9. The requirements and methods for anonymization are assigned to the level of the Government of the Russian Federation.<\/li>\n
  10. The forms for obtaining personal data are clarified in part 1 of article 9, and electronic consent forms are formally legalized: SMS, website forms, and other methods.<\/li>\n
  11. The data subject will have the opportunity to change the purposes of processing personal data declared in the (single) consent. The principle of \"One purpose \u2013 one consent\" is canceled here. Corresponding changes to the merger of purposes are introduced in part 4 of article 9. If the data processor refuses to amend the consent, the reasoned refusal can be appealed to Roskomnadzor.<\/li>\n
  12. According to part 4 of article 9, the signing of consent in electronic form is simplified; now instead of \"in the form of an electronic document signed in accordance with federal law by electronic signature,\" it is planned to be: \"signed in accordance with federal law by electronic signature or confirmed in any way that allows reliably determining the data subject and establishing their will.\"<\/li>\n
  13. In fact, the informal practice of publishing a list of third parties processing personal data on the website is being legalized.<\/li>\n<\/ol>\n

    \nAs reported by the Telegram channel Privacy Experts (@privacyexperts<\/a><\/noindex>):<\/p>\n

    The bill contains broadly interpreted concepts. For example, \"warnings and prevention of unlawful acts\" or \"socially significant purposes.\"<\/p>\n

    At the same time, the bill does not contain solutions if as a result of processing the aggregate data, it becomes possible to attribute specific personal data to a particular subject.<\/p>\n

    It is evident that the position of the data subject is deteriorating, while risks for the data operator are not excluded, related to the documentation of personal data processing processes for new types of processing.<\/p>\n

    It is unclear what order should be followed to delete data when changing the purposes of processing in the 'Unified Consent'. <\/p><\/blockquote>\n

    \nThe explanatory note concludes by stating that the draft law complies with the provisions of the Treaty on the Eurasian Economic Union dated May 29, 2014, as well as the provisions of other international treaties of the Russian Federation, and will not affect the indicators of the state programs of the Russian Federation and their results.
