La empresa Xiaomi, uno de los mayores fabricantes de smartphones, dispositivos inteligentes y plataformas IoT, se ha unido a la organizaci\u00f3n Open Invention Network (OIN), que se encarga de proteger el ecosistema Linux de reclamaciones de patentes. Al unirse a OIN, la compa\u00f1\u00eda ha demostrado su compromiso con el desarrollo colaborativo de la innovaci\u00f3n y la gesti\u00f3n no agresiva de las patentes. Se destaca que Linux y las tecnolog\u00edas abiertas son una parte clave de los productos de Xiaomi, y la empresa tiene la intenci\u00f3n de continuar desarrollando e integrando software de c\u00f3digo abierto en sus productos, as\u00ed como participar en el desarrollo de Linux y en varios proyectos abiertos. <\/p>\n

Los participantes de OIN se comprometen a no presentar reclamaciones de patentes y permiten de forma gratuita el uso de tecnolog\u00edas patentadas en proyectos relacionados con el ecosistema Linux. OIN cuenta con m\u00e1s de 3500 empresas, comunidades y organizaciones que han firmado un acuerdo de licencia para el uso compartido de patentes. Entre los principales participantes de OIN, que contribuyen a la formaci\u00f3n de un grupo de patentes que protege a Linux, se encuentran empresas como Google, IBM, NEC, Toyota, Renault, SUSE, Philips, Red Hat, Alibaba, HP, AT&T, Juniper, Facebook, Cisco, Casio, Huawei, Fujitsu, Sony y Microsoft. <\/p>\n

Las empresas que firman el acuerdo obtienen acceso a las patentes que posee OIN a cambio del compromiso de no presentar reclamaciones legales por el uso de tecnolog\u00edas utilizadas en el ecosistema de Linux. En particular, al unirse a OIN, la empresa Microsoft cedi\u00f3 a los participantes de OIN el derecho a utilizar m\u00e1s de 60,000 de sus patentes, comprometi\u00e9ndose a no usarlas contra Linux y el software de c\u00f3digo abierto. <\/p>\n

El acuerdo entre los participantes de OIN se aplica \u00fanicamente a los componentes de las distribuciones que caen bajo la definici\u00f3n de sistema Linux («Linux System»). Actualmente, la lista incluye 3393 paquetes, incluyendo el n\u00facleo de Linux, la plataforma Android, KVM<\/a>, Git, nginx, Apache Hadoop, CMake, PHP, Python, Ruby, Go, Lua, LLVM, OpenJDK, WebKit, KDE, GNOME, QEMU, Firefox, LibreOffice, Qt, systemd, X.Org, Wayland, PostgreSQL, MySQL, etc. Adem\u00e1s de los compromisos de no agresi\u00f3n, se ha formado un pool de patentes dentro de OIN, que incluye patentes adquiridas o cedidas gratuitamente por los miembros, relacionadas con Linux. <\/p>\n

El grupo de patentes de OIN incluye m\u00e1s de 1300 patentes. Entre ellas, OIN posee un conjunto de patentes que contienen algunas de las primeras menciones de tecnolog\u00edas para crear contenido web din\u00e1mico, que precedieron la aparici\u00f3n de sistemas como ASP de Microsoft, JSP de Sun\/Oracle y PHP. Otra contribuci\u00f3n importante fue la adquisici\u00f3n en 2009 de 22 patentes de Microsoft, que previamente hab\u00edan sido vendidas al consorcio AST como patentes que afectan a productos de «open source». Todos los participantes de OIN tienen la posibilidad de utilizar estas patentes de forma gratuita. La validez del acuerdo de OIN fue confirmada por una decisi\u00f3n del Ministerio de Justicia de EE.
