El 10 de junio, por en\u00e9sima vez, circul\u00f3 en los chats una broma sobre un script que elimina datos de un sistema productivo. Y as\u00ed me surgi\u00f3 la pregunta: \u00bfentiende la comunidad lo que realmente est\u00e1 pasando y qui\u00e9n es el culpable?<\/p>\n

As\u00ed que, en concreto, la situaci\u00f3n.<\/p>\n

Walsya, el administrador del sistema, gestiona la infraestructura de cierto negocio. Y no es muy listo.
\nWalsya se enfrent\u00f3 a un problema y acudi\u00f3 a la comunidad (chat de Telegram \/ foro) pidiendo consejo. Unya, el bromista de esa comunidad, dice: \"Aqu\u00ed tienes un script maravilloso, ejec\u00fatalo\", sabiendo que Walsya lo har\u00e1 en el sistema productivo y que \u00e9l no leer\u00e1 ni comprender\u00e1 lo que hay dentro.<\/p>\n

Resultado: datos eliminados, tiempo de inactividad del negocio, p\u00e9rdida de dinero.

\nLa cuesti\u00f3n de la culpa de Walsya no se plantea, \u00e9l es sin duda culpable y ha expuesto la infraestructura a lo que es pr\u00e1cticamente un ataque hacker, violando todas las posibles instrucciones de seguridad de la informaci\u00f3n. <\/p>\n

Cabe se\u00f1alar que me gustar\u00eda considerar primero la situaci\u00f3n desde un punto de vista moral, y no legal. \u00bfCu\u00e1l es la diferencia?<\/p>\n

  1. No necesitamos probar que es efectivamente Unya. No necesitamos probar la intencionalidad de las acciones de Unya. Este es un hecho conocido.<\/li>\n
  2. No necesitamos calificar las acciones de Unya seg\u00fan los art\u00edculos del c\u00f3digo penal y tratar de incriminarlo.<\/li>\n
  3. La cuesti\u00f3n es solo si se puede considerar que Unya es culpable. \u00bfEn qu\u00e9 grado es culpable Unya?<\/li>\n<\/ol>\n

    \n\u00bfLleva Unya responsabilidad moral por las acciones de Walsya o es simplemente un tonto?<\/p>\n

    Hay una opini\u00f3n com\u00fan en la comunidad de que Walsya es un tonto, un irresponsable. \u00a1Pwnd! \u00a1Unya es genial, ha humillado al tonto, jaja! Sin embargo, Unya no tiene absolutamente ninguna culpa por las consecuencias, todo recae en Walsya.<\/p>\n

    Hay una opini\u00f3n menos com\u00fan de que Unya es 100% culpable de haber arrastrado a Walsya a esta situaci\u00f3n y lleva la plena responsabilidad posterior (en un sentido moral, no legal) por las consecuencias: incendios, muertes de personas, p\u00e9rdidas financieras. Y al final, Unya podr\u00eda ser castigado por el propietario de este negocio mediante un \"resarcimiento\".<\/p>\n

    Me gustar\u00eda escuchar la opini\u00f3n de la comunidad sobre este asunto. Tal vez incluso, si hay abogados profesionales, una opini\u00f3n legal.<\/p>\n
