Josephine Staton, the judge handling the case, refused to dismiss the lawsuit on the grounds that the plaintiff is not a beneficiary of copyright infringement proceedings, as fulfilling the additional contractual obligation stated in the GPL license is separate from the rights granted by copyright law. The ruling to return the case to the district court noted that the GPL acts simultaneously as both a license to use the copyright-protected work and as a contractual agreement. <\/p>\n
The lawsuit against Vizio was filed in 2021 after three years of attempts to resolve the GPL licensing requirements amicably. GPL packages such as the Linux kernel, U-Boot, Bash, gawk, GNU tar, glibc, FFmpeg, Bluez, BusyBox, Coreutils, glib, dnsmasq, DirectFB, libgcrypt, and systemd were found in Vizio's smart TV firmware, but the company did not offer users the opportunity to request the source code of the GPL components of the firmware, nor did it mention the use of software under copyleft licenses and the rights provided by these licenses in its informational materials. The lawsuit does not seek monetary compensation; the SFC merely requests the court to compel Vizio to comply with GPL conditions in its products and to inform consumers of the rights granted by copyleft licenses. <\/p>\n
A manufacturer using code under copyleft licenses in their products must provide the source code, including the code for derivative works and installation instructions, to preserve software freedom.
