Ryan Dahl, a developer of the JavaScript platforms Node.js and Deno, is seeking to revoke the trademark \"JavaScript\" from Oracle. The first step was publishing an open letter to Oracle last year, urging the company to abandon the JavaScript trademark, as this term has become a generic term, unrelated to specific Oracle products and widely used by individuals and companies. <\/p>\n
Oracle has not responded to the call, and Ryan attempted to annul the trademark at the United States Patent and Trademark Office (USPTO). A petition to cancel the trademark was submitted to the Trademark Trial and Appeal Board (TTAB), which outlined three claims: misleading representation during the trademark renewal, generic usage of the trademark, and non-use of the trademark in the owner's products. <\/p>\n
A few days ago, the Appeals Council rejected the first claim, which argued that during the renewal of its rights to the \"JavaScript\" trademark in 2019, Oracle misled the USPTO and provided false information. To demonstrate its products using the \"JavaScript\" trademark, Oracle presented a screenshot from the Node.js platform website, which is not affiliated with Oracle and has never been its product. Ryan disagrees with this decision but does not intend to waste resources to contest it, as it would only prolong the litigation for months. <\/p>\n

\"JavaScript\" is widely used to describe the programming language defined by the ECMA-262 specification, rather than a brand or product of Oracle, which has no connection to the evolution of the JavaScript language. The term JavaScript is used by millions of developers around the world, independent of Oracle. Oracle has never controlled the specification development process or the usage of the language. According to current U.S. law, words that have become generic terms cannot remain trademarks.\n
The \"JavaScript\" trademark was acquired by Oracle along with the assets of Sun Microsystems and does not directly associate with any Oracle products in practice. The JavaScript language is standardized by the Ecma association, managed by the TC39 working group, and implemented by companies such as Apple, Google, and Mozilla. U.S. legislation considers trademarks that have not been used for three years as abandoned. <\/ul>\n
