Ryan Dahl, creator of the JavaScript platforms Node.js and Deno, is seeking to revoke the trademark "JavaScript" from Oracle. The first step was the publication of an open letter to Oracle last year, urging them to abandon the JavaScript trademark, as the term has become a common term unrelated to Oracle's specific products and is widely used by individuals and companies.
Oracle has not responded to the request, and Ryan attempted to challenge the trademark at the United States Patent and Trademark Office (USPTO). A petition was submitted to the Trademark Trial and Appeal Board (TTAB) seeking the cancellation of the trademark, which included three claims: misleading information during the renewal of the trademark, generic use of the trademark, and non-use of the trademark in its owner's products.
A few days ago, the Appeal Board dismissed the first claim, which stated that during the renewal of its rights to the "JavaScript" trademark in 2019, Oracle misled the USPTO by providing inaccurate information. As evidence of its products using the "JavaScript" trademark, Oracle presented a screenshot from the Node.js platform, which is in no way associated with Oracle and has never been its product. Ryan disagrees with this decision but does not intend to expend resources contesting it, as that would only prolong the dispute for months.
It has been decided to focus efforts on the remaining two claims — the generic nature of the term "JavaScript" and the non-use of the trademark in Oracle's products:
- The term "JavaScript" is widely used to describe the programming language defined by the ECMA-262 specification, rather than a brand or product of Oracle, which has no connection to the evolution of the JavaScript language. The term JavaScript is used by millions of developers worldwide, independent of Oracle. Oracle has never controlled the specification development process or the use of the language. According to current U.S. law, words that have become generic terms cannot remain trademarks.

Până pe 7 august, reprezentanții Oracle trebuie să prezinte USPTO răspunsuri la toate punctele menționate în cererea de anulare a mărcii comerciale. După aceea, pe 6 septembrie, va începe o audiere la USPTO. Peste 20.000 de dezvoltatori au semnat o petiție care afirmă că marca comercială „JavaScript” nu servește intereselor publice și împiedică industria.
Se remarcă faptul că existența unei mărci comerciale active îi forțează pe comercianții care dezvoltă produse legate de limbajul JavaScript să acționeze în zona gri, folosind acest nume atâta timp cât compania Oracle nu formulează cereri. De exemplu, din cauza temerilor legate de posibile revendicări din partea Oracle, nu a fost creată „Conferința JavaScript”. Se presupune că Oracle păstrează marca comercială nefolosită pentru a-și menține influența asupra ecosistemului din care nu mai face parte.
