The first step was the publication last year of an open letter to Oracle urging them to abandon the trademark JavaScript, as this term has become a generic term not associated with specific Oracle products and is widely used by people and companies. <\/p>\n

A few days ago, the Appeals Board rejected the first claim, which stated that during the renewal of its rights to the trademark \"JavaScript\" in 2019, Oracle misled the USPTO and provided false information. As proof of its products using the \"JavaScript\" trademark, Oracle presented a screenshot from the Node.js platform's website, which is not related to Oracle and has never been its product. Ryan disagrees with this decision but does not intend to spend resources contesting it, as it would only prolong the proceedings for months. <\/p>\n
It has been decided to focus efforts on the remaining two claims \u2014 the generic nature of the term \"JavaScript\" and the non-use of the trademark in Oracle products: <\/p>\n

The word \"JavaScript\" is widely used to describe the programming language defined by the ECMA-262 specification, not a brand or product of Oracle, which is not associated with the evolution of the JavaScript language. The term JavaScript is used by millions of developers around the world, independently of Oracle. Oracle has never controlled the development process of the specification or the use of the language. Under current US law, words that have become generic terms cannot remain trademarks.\n
The trademark \"JavaScript\" was acquired by Oracle along with the assets of Sun Microsystems and does not directly associate with any of Oracle's products. The JavaScript language is standardized by the Ecma Association, managed by the TC39 working group, and is implemented by companies such as Apple, Google, and Mozilla.
