Skolkovo experts suggest using big data for digital regulation

According to online sources, Skolkovo experts propose using big data to amend legislation, introduce regulation of the “digital footprint” of citizens and control over Internet of things (IoT) devices.

The proposal to analyze large amounts of data to make adjustments to the current legislation was set out in the "Concept for the integrated regulation of relations arising in connection with the development of the digital economy." This document was developed by specialists from the Institute of Legislation and Comparative Law under the Government of the Russian Federation by order of Skolkovo.

According to Sergey Izraylit, head of the department for development of the Skolkovo Foundation, this model is more effective than traditional methods, when standards are developed based on human analysis and customer requirements. He also noted that the creation of the concept is carried out within the framework of the national program "Digital Economy". Currently, there is only an intermediate version, which is being discussed with experts. 

Mr. Izrailit explained that the main idea of ​​the presented concept is to make timely changes to the regulation so that it does not harm the economic condition of any entities. As an illustrative example, it is proposed to consider a situation where, despite the demand of citizens for travel by public transport to a certain place, stopping there is prohibited by the current rules. Because of this, the flow of visitors to shops and restaurants in this place is reduced, which leads to a deterioration in the investment attractiveness of the entire area. Using the data accumulated on digital platforms like Yandex.Maps, it is possible to link regulatory decisions to real demand, thereby creating a more effective regulatory model.  

As for the regulation of the “digital footprint” of citizens, the term itself is defined in the document as a set of data on “user actions in the digital space”. It is proposed to regulate the so-called "active" traces. We are talking about user information that remains in social networks, personal accounts on different sites, etc. A passive trace is formed from data left intentionally or resulting from the operation of the corresponding software. In the document under consideration, such data includes information collected by device operating systems, search engines, etc. It is not planned to regulate this information.
