According to him, the basis for the ban was the conclusion that Apple violated a Qualcomm patent relating to smartphone technology.

It should be noted that the preliminary decision of the administrative law judge is not binding. The final decision on this issue will be taken at the ITC meeting.

The judge also said Apple did not infringe on the other two Qualcomm patents at issue in the case.

"We appreciate Judge McNamara's recognition of Apple's infringement of our hardware patent and that she will recommend an import injunction as well as a cease and desist order," Qualcomm General Counsel Don Rosenberg said in a statement.

Apple has yet to respond to Reuters' request for comment on the ITC judge's decision.

The ITC is expected to soon issue a final decision in another case, in which the chipmaker is also seeking a ban on the sale of certain iPhone models with Intel chips in the United States.
